These Terms of Service ("ToS") govern your use of our subscription-based Discord bot (the "Bot": DayZ XML Injector). By using the Bot, you agree to be bound by this ToS. If you do not agree with this ToS, you will not be allowed to use the Bot.

  1. Subscription Terms

    The Bot requires a subscription to access certain features. By subscribing to the Bot, you agree to pay the subscription fee at the rate and frequency indicated. The subscription will automatically renew unless you cancel it before the renewal date. You are responsible for keeping your subscription information up to date.

  2. Bot Usage

    You may use the Bot only for lawful purposes and in compliance with these ToS. You may not use the Bot in any way that violates any applicable laws or regulations, infringes on the rights of others, or harms or interferes with the operation of the Bot or its users.

  3. User Content

    You are solely responsible for any content you upload, post, or transmit using the Bot. You represent and warrant that you have all necessary rights to use such content and that it does not infringe on the rights of any third party. We reserve the right to remove any content that we believe violates these ToS or is otherwise inappropriate. If an infringement is committed we also reserve the right to terminate the use of this bot.

  4. Intellectual Property

    The Bot and its content, including but not limited to text, graphics, images, and software, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Bot or its content without our prior written consent.

  5. Termination

    We may terminate or suspend your use of the Bot at any time and without prior notice if we believe that you have violated these ToS or for any other reason. Upon termination, you must immediately stop using the Bot and delete all copies of the Bot in your possession.

  6. Disclaimers and Limitation of Liability

    THE BOT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED OR ERROR-FREE. IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE BOT.

  7. Indemnification

    You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Bot, your violation of these ToS, or your violation of any applicable law or regulation.

  8. Governing Law and Jurisdiction

    These ToS shall be governed by and construed in accordance with the laws of the jurisdiction specified in Discord's Terms of Service[](https://discord.com/terms). Any disputes shall be resolved in accordance with the dispute resolution procedures outlined therein.

  9. Changes to These ToS

    We may modify these ToS at any time and without prior notice. Your continued use of the Bot after any such modifications shall constitute your acceptance of the modified ToS.

  10. Entire Agreement

    These ToS constitute the entire agreement between you and us with respect to the Bot and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
